IN NO EVENT SHALL THE TOTAL CUMULATIVE LIABILITY OF COSTA VIDA TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE GREATER OF: (A) THE AMOUNT PAID BY YOU TO COSTA VIDA IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).
The foregoing limitations of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction. Some states do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you.
8. Indemnification

12. Dispute Resolution
12.1 Informal Resolution

Both parties agree to engage in good-faith discussions to attempt to resolve any dispute before escalating to formal proceedings.

If the parties are unable to resolve a dispute informally within sixty (60) days of the initial notice, any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules, as modified by these Terms. The decision of the arbitrator shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
12.3 Class Action Waiver
YOU AND COSTA VIDA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. Unless both you and Costa Vida agree in writing, no arbitrator or judge may consolidate more than one person's claims or otherwise preside over any form of a representative or class proceeding.
12.4 Exceptions
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction for matters related to intellectual property rights, unauthorized access to the Site, or other matters where irreparable harm may result from delay.
13. Term and Termination
These Terms shall remain in full force and effect while you use the Site or Services. Costa Vida reserves the right, in its sole discretion and without notice or liability, to:
